The primary legal basis for EIA is the Law on Environmental Protection (2020), supported by implementing regulations, most notably Decree No. 08/2022/ND-CP and relevant technical guidelines.

Projects are classified into Group I, Group II, Group III, or Group IV based on their environmental risk, scale, location, and type of activity.

Environmental Project Classification and Study Requirements

EIA projects in vietnam are classified as:
Group I (High Environmental Risk):
Projects with significant potential environmental impacts, such as industrial manufacturing, chemical processing, energy facilities, and projects involving hazardous substances. These projects must prepare a Full Environmental Impact Assessment (EIA) and obtain approval before implementation.
Group II (Medium Environmental Risk):
Projects that may require either a Full EIA or an Environmental License, depending on environmental sensitivity, emissions, and location.
Group III (Low Environmental Risk):
Projects generally subject to an Environmental License, without the need for a Full EIA.
Group IV (Very Low Environmental Risk):
Projects requiring only Environmental Registration.
